# Notia 利用規約
本利用規約（以下「本規約」）は、Yoshinori Suzuki ［KUNYOTSU Labs］（以下「当方」）が提供する iPad 用アプリケーション「Notia」（以下「本アプリ」）の利用条件を定めるものです。利用者は、本アプリをダウンロード、インストールまたは利用した時点で、本規約に同意したものとみなします。
## 第1条（適用）
本規約は、本アプリの利用に関する当方と利用者との間の一切の関係に適用されます。
## 第2条（利用許諾）
1. 当方は利用者に対し、本規約に従うことを条件に、本アプリを利用者個人の iPad 上で使用する、非独占的で譲渡および再許諾のできない権利を許諾します。
2. 本アプリに関する著作権、商標権その他一切の知的財産権は、当方または正当な権利者に帰属します。
## 第3条（サブスクリプション）
1. 本アプリの利用には、自動更新サブスクリプションへの登録が必要です。プランと料金は以下のとおりです。
– 月額プラン: 300円（税込）／月
– 年額プラン: 1,000円（税込）／年
2. 初回登録時に 7 日間の無料トライアルをご利用いただけます。トライアル期間の終了までに解約されない場合、選択したプランの料金が自動的に課金されます。
3. 料金は利用者の Apple アカウントに課金されます。サブスクリプションは、期間終了の 24 時間前までに解約されない限り自動的に更新され、更新料金は期間終了前 24 時間以内に課金されます。
4. サブスクリプションの管理および解約は、購入後に iPad の「設定」または App Store のアカウント設定からいつでも行えます。当期分の料金の払い戻しは、Apple のポリシーに従います。
5. 無料トライアルの未使用分は、サブスクリプションを購入した時点で失効します。
## 第4条（禁止事項）
利用者は、本アプリの利用にあたり、以下の行為をしてはなりません。
1. 本アプリのリバースエンジニアリング、逆コンパイル、逆アセンブル
2. 本アプリの複製、改変、翻案、再配布、販売、貸与
3. 法令または公序良俗に違反する行為
4. 本アプリの運営を妨害し、またはサーバー等に過度な負荷をかける行為
5. その他、当方が不適切と判断する行為
## 第5条（提供の停止・変更）
当方は、保守、システム障害、その他やむを得ない事由がある場合、事前の通知なく本アプリの提供の全部または一部を停止・変更することがあります。これにより利用者に生じた損害について、当方は責任を負いません。
## 第6条（免責事項）
1. 本アプリは「現状有姿」で提供され、当方は本アプリの完全性、正確性、有用性、特定目的への適合性について、いかなる保証も行いません。
2. 本アプリの利用により利用者に生じた損害について、当方の故意または重過失による場合を除き、当方の賠償責任は、当該利用者が過去 12 ヶ月間に本アプリに対して支払った料金の合計額を上限とします。
3. 利用者は、重要なデータについて自らバックアップを行う責任を負います。
## 第7条（データの取扱い）
本アプリで作成された手書きデータ、メモ、画像、録音その他のコンテンツは、利用者の端末内および利用者自身の iCloud アカウント（iCloud 同期をオンにした場合）にのみ保存され、当方がこれを取得することはありません。詳細は「[プライバシーポリシー](https://kunyotsu.com/entry/privacypolicy-notia/)」をご確認ください。
## 第8条（本規約の変更）
当方は、必要と判断した場合、利用者への事前の通知なく本規約を変更できるものとします。変更後の規約は、本ページに掲載した時点で効力を生じます。
## 第9条（準拠法・裁判管轄）
本規約は日本法に準拠し、本アプリに関して紛争が生じた場合、当方所在地を管轄する裁判所を専属的合意管轄とします。
## 第10条（Apple との関係）
1. 本規約は、当方と利用者との間で締結されるものであり、Apple Inc.（以下「Apple」）は本規約の当事者ではありません。
2. 本アプリおよびその内容に関する責任は、Apple ではなく当方が負います。保守・サポート、製品保証、製造物責任その他の請求への対応義務はすべて当方にあります。
3. Apple および Apple の子会社は本規約の第三受益者であり、利用者が本規約に同意した時点で、Apple は第三受益者として本規約を利用者に対して執行する権利を有します。

# Notia Terms of Use
These Terms of Use (“Terms”) set forth the conditions for using the iPad application “Notia” (the “App”) provided by Yoshinori Suzuki [KUNYOTSU Labs] (“we” or “us”). By downloading, installing, or using the App, you are deemed to have agreed to these Terms.
## Article 1 (Application)
These Terms apply to all relationships between you and us regarding the use of the App.
## Article 2 (License)
1. Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, non-sublicensable right to use the App on your personal iPad.
2. All copyrights, trademarks, and other intellectual property rights in the App belong to us or their rightful owners.
## Article 3 (Subscription)
1. Use of the App requires an auto-renewable subscription. Plans and prices:
– Monthly Plan: ¥300 (tax included) / month
– Yearly Plan: ¥1,000 (tax included) / year
2. A 7-day free trial is available on first registration. Unless canceled before the end of the trial, the price of the selected plan will be charged automatically.
3. Payment will be charged to your Apple Account. The subscription automatically renews unless canceled at least 24 hours before the end of the current period, and the renewal fee is charged within 24 hours before the period ends.
4. You can manage or cancel your subscription at any time in your device Settings or your App Store account settings after purchase. Refunds for the current period are subject to Apple’s policies.
5. Any unused portion of a free trial is forfeited when you purchase a subscription.
## Article 4 (Prohibited Conduct)
You must not: (1) reverse engineer, decompile, or disassemble the App; (2) copy, modify, adapt, redistribute, sell, or lend the App; (3) violate laws or public order and morals; (4) interfere with the operation of the App or place an excessive load on servers; or (5) engage in any other conduct we deem inappropriate.
## Article 5 (Suspension and Changes)
We may suspend or change all or part of the App without prior notice for maintenance, system failure, or other unavoidable reasons, and shall not be liable for any resulting damage.
## Article 6 (Disclaimer)
1. The App is provided “as is,” without any warranty of completeness, accuracy, usefulness, or fitness for a particular purpose.
2. Except in cases of our willful misconduct or gross negligence, our liability for damages arising from your use of the App shall be limited to the total amount you paid for the App in the preceding 12 months.
3. You are responsible for backing up your important data.
## Article 7 (Data Handling)
Handwriting, notes, images, recordings, and other content created in the App are stored only on your device and in your own iCloud account (if iCloud sync is enabled); we never receive them. See our [Privacy Policy](https://kunyotsu.com/entry/privacypolicy-notia/) for details.
## Article 8 (Changes to These Terms)
We may change these Terms without prior notice when we deem it necessary. The revised Terms take effect when posted on this page.
## Article 9 (Governing Law and Jurisdiction)
These Terms are governed by the laws of Japan. Any dispute regarding the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over our location.
## Article 10 (Relationship with Apple)
1. These Terms are concluded between you and us; Apple Inc. (“Apple”) is not a party to these Terms.
2. We, not Apple, are responsible for the App and its content, including maintenance, support, product warranties, and product liability claims.
3. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.
